Provide 50% Reservation to In service Doctors in Super-Specialty Courses: Madras High Court. For the academic year 2021-22, the Madras High Court ruled that in-service government doctors be given 50% of seats in super-specialty programmes at government medical institutions in Tamil Nadu.

After hearing comments from senior counsel P Wilson and advocate G Sankaran, Justice M Dhandapani instructed the State government to enforce the G.O. dated November 7, 2020, on a plea brought by Dr D Suresh, an assistant professor at Madras Medical College.

The HC ruling comes after a Supreme Court Panel ruled in 2020, based on a Kerala government plea, that in 2021-22, 50% of super speciality seats can be allocated to in-service physicians provided no legal barrier exists.It may be noted that till 2016, the Tamil Nadu government allocated 50% of super-specialty seats to in-service doctors through a state-level admission exam.

NEET-PG score and weightage for services in rural/difficult/hilly regions were taken into consideration for admission after the national eligibility cum entrance test (NEET) was implemented. The Medical Council of India, on the other hand, changed its norms to prohibit such discrimination. The State quota was also a source of contention for the Centre. After in-service and non-service doctors launched legal action, the case reached the courts.

A bigger Supreme Court panel had ruled that rule 9 of the MCI rules, 2000, does not impact states that provide distinct reservations for in-service doctors seeking admission to postgraduate courses, according to the petitioner. The Tamil Nadu government issued two GOs in response to the apex court ruling, reserving 50% of seats in PG and super-specialty programmes for government physicians.
