Federal Judge Rules that CDC Does Not Have Authority to Extend Eviction Moratorium

On May 5th, 2021 a federal judge ruled the CDC on its own does not have the authority to extend the Eviction Moratorium. Originally the eviction moratorium was authorized and supported by congress through the CARES Act. Congress acted to extend the eviction moratorium a second time through the cares act. However, the most recent extension was just authorized through the CDC alone without congress. Several realtors and realtor associations have sued the CDC for the extension on the moratorium and a federal judge has ruled that the CDC cannot extend a moratorium without congress.

Undoubtedly, this ruling did send many into a panic when they heard the news. However, there are 18 states, including California, that have their own eviction moratorium in place.
