Elon Musk's X Social Media Is Sued By X, Another Social Media Company

When something is so influential and popular, there will be something or someone that wants to grab a share of that.

At least financially, when a Florida-based Social Media company, called X Social Media, is suing Elon Musk’s X, formerly Twitter, for utilizing the X branding.

The company in question is X Social Media LLC, a Floridian company that manages social media platforms for lawyers.

Because Musk did what he did, the X social media claims it has "already suffered loss in revenue that correlates with X Corp.’s rebrand and use of the mark ‘X.’

This X alleges that Musk's X Corp. is guilty of violating Florida common law because of "unfair competition and trademark and service mark infringement," as well as the state’s Deceptive and Unfair Trade Practices Act.

Musk was quick in rebranding Twitter.

Not long after he acquired Twitter for an eye-watering $44 billion, he renamed it to X

And soon after he registered the company as X Corp., in order to make X an "everything app," the remaining staff he didn't fire or left worked to get the platform up with speed, and had removed any old branding like the words "tweet" and "retweet."

Lawsuit like this was already predicted, and many have thought that it was bound to happen sooner or later.

While this X Social Media is significantly smaller than Musk's X, what is certain is that, the "X" trademark is a "crowded field."

Before Musk even renamed Twitter to X, there were nearly 900 trademark registrations covering the letter “X” across various industries. Among them, included one belonging to Meta for social networking services in entertainment and another belonging to Microsoft for gaming.

This could make it extremely hard for anyone to claim the X branding, or even enforce a claim against another.

While X Corp. itself has filed to register “X” for use in association with social media, business data analytics, market research and advertising services, among various other areas. The other X however, said that it has used the mark in identical and closely-related services continuously since 2016.

In other words, the lawsuit happened because this X said that it has used its registered trademark, "X SOCIALMEDIA" for over eight years.

The X Social Media which claims to have a federal trademark for X said that it has been using the brand, and invested a reported $400 million into Facebook and social media campaigns in an effort to reach more customers.

But because Musk's X Corp is significantly larger and more popular, according to the lawsuit, X Corp, Musk’s company, dominates various search engines' results pages when typing in “X Social Media”.

And the rebrand has confused its consumers by leading them to believe that the company’s ad services are associated with the Musk-led company.

"They also encompass services and market channels where X Social Media has labored for years to successfully cultivate brand awareness for its X SocialMedia Mark among consumers," states the complaint, which describes the business as utilizing social media to connect consumers with legal services.

So here, because the X Social Media is said to be a registered trademark, the rebranding of Twitter to X should be considered an "exceptional" trademark infringement, which caused it a loss in revenue.

And because of this, this X Social Media company is requesting an undisclosed sum of money for damages against the company.

It' worth noting that Musk is no stranger to lawsuits and attending courts. And X itself has been previously sued for copyright infringement, wrongful termination and employment discrimination.
