Train Accidents in Michigan

The majority of the about 5,800 annual train-related incidents in the United States occur at railroad crossings, as reported by the Department of Transportation. Nearly 600 people are killed, and over 2,300 are injured in railway accidents every year because of the size, weight, and speed of trains.

Unfortunately, negligence and carelessness, such as distraction, falling asleep at the wheel, or driving under the influence of drugs or alcohol, may lead to devastating consequences in any crash, and train accidents are no exception. When a railroad worker violates safety protocols, changes tracks incorrectly, or fails to keep an eye out for hazards, other trains are more likely to collide with theirs.

Moreover, negligence leads to railway accidents for a variety of reasons, including poor judgment, eyesight problems, and impaired reflexes. According to the Federal Railroad Administration, every two weeks, a train transporting hazardous commodities derails in the United States. Still, per the FRA, almost 1,000 individuals per year lose their lives in train-related incidents, with one death anticipated every 100 minutes.

In Michigan, anybody who suffers injuries as a result of a crash or the death of a loved one in an accident must notify the proper authorities as quickly as feasible, but in any case, within 24 hours. In addition, you must report the occurrence to your own no-fault auto insurance company.

Many insurance plans have strict notice periods, so you must notify your insurance provider of this occurrence within that time frame. The policyholder runs the risk of losing coverage if this is not done. Further, if you were hurt in such an accident, have increasing medical costs, or have missed time from work because of the incident, you should apply for no-fault benefits as quickly as possible so that you may get the compensation to which you are entitled.

No matter the details of your accident or the scope of your losses, an attorney can help you gather the evidence you need and navigate the complicated legal structure of Michigan’s personal injury laws and procedures.
