Is A Personal Injury Claim Right For You?

If there’s one thing you can count on in life it’s: life is unpredictable.

Now, more than ever, we’re on-the-go, all-consumed, and constantly distracted. It makes it even easier for something unexpected to happen, like an unfortunate event typically resulting in damage or Injury. This is also known as an accident.

In legal terms, a Personal Injury case involves a situation where an accident has occurred and another person (or business) is found to be at fault and legally responsible for causing injuries. Although, the situation or accident cannot be reversed (unfortunately, we haven’t learned to time travel yet!), the remedy to the accident can come in the form of settlement – money that’s paid to the injured party (the plaintiff) from the liable party (the defendant).

After an accident or injury occurs to you or your loved one, you have an option to take steps toward protecting your legal rights. But how do you decide if the wrong that’s happened upon you is something you should try to make right? It’s not uncommon to have a number of questions about Personal injury cases – including the most basic question, “How do I decide if pursuing a personal injury case is right for my situation?”

It’s important to keep in mind that most personal injury cases are due to negligence.

Here’s an example: when a driver gets behind the wheel of a car, he or she has a legal obligation to other drivers – to operate his/her vehicle with care and caution, including obeying all traffic laws. If the driver runs a red light or makes a wrong turn and hits another car or person, that driver is usually at fault and can be deemed negligent.

But accidents are just one of the different types of personal injury. Intentional acts (assault and battery included), defective products, and, sometimes, even defamation that causes to harm another person’s reputation are all considered personal injury case examples.

Personal Injury case examples

Here are some personal injury case examples:

  • Bicycle or Motorcycle Accidents
  • Boat, Bus, Car, or Truck Accidents
  • Catastrophic Injuries
  • Medical Malpractice
  • Assault, Battery, or Other Intentional Acts
  • Dog or Other Pet Bites
  • Negligent Security
  • Workplace Accidents
  • Product Injuries
  • Nursing Home Abuse
  • Pedestrian Accidents
  • Slip and Fall
  • Wrongful Death

Although there are a variety of different situations that can result in a personal injury case, it’s important to keep in mind that not every situation in which someone is injured is going to result in liability case.
