On April 5th, 2016, we received another EB-2 NIW (National Interest Waiver) approval for a Ph.D. Candidate in the Field of Electrical Engineering (Approval Notice).

A Ph.D. candidate engaged North America Immigration Law Group’s expert services to help him file an EB-2 NIW (National Interest Waiver) petition. At first glance, his master’s degree and extensive electrical engineering experience made him a suitable candidate for EB-2 NIW. After carefully evaluating his credentials to be sure that we could build a strong case, we determined that he qualified for the National Interest Waiver.
Part of our services included helping our client select potential candidates who could contribute strong Recommendation Letters in support of his EB-2 NIW petition. We carefully selected these candidates and made sure that they were experts in the field of electrical engineering, were familiar with our client’s work, and/or had worked with him. The five experts whom we narrowed down all agreed to lend their support and our client returned with five signed recommendation letters, one of which stated that “…in order to ensure his continued excellence in the field, [Client’s] position in the United States must be secured, without hesitation. Anything less would amount to a major setback in our nation’s quest to ensure a secure energy future.”
Accompanying these recommendation letters were details on our client’s 3 publications, the 103 citations gathered from his work, and his peer review experience (he was a manuscript reviewer for over a dozen internationally-circulated journals and conferences). We also reviewed his work on power electronics and advanced renewable energy systems, and established that they contribute to the United States’ energy independence and energy efficiency initiatives, environmental programs, and overall economic prosperity.
Filing an I-485 application while the I-140 petition is pending approval:
Our client chose to embark on the final leg of the green card journey (filing an I-485 application) while his EB-2 NIW petition was pending approval. This is not unusual and many applicants choose to do this to save time. Our client is currently waiting for the USCIS to take action on his I-485 application. In the meantime, we wish him well with his continued research efforts.
