On October 27^th, 2017, and May 20^th, 2017, we received another EB-1A (Alien of Extraordinary Ability) approval for a Post-doctoral Researcher in the Field of Synthetic Chemistry (Approval Notice).

Case Summary:

A noted Postdoctoral Researcher from China hired North America Immigration Law Group (WeGreened.com) to represent him in two I-140 cases- an EB-1A (Alien of Extraordinary Ability) and an EB-2 NIW (National Interest Waiver). Many of our clients ask us to file these two petitions together because it significantly increases their chances of obtaining an approval, and also because these visa categories are quite similar, in that they have a few overlapping eligibility requirements. The following points were stated in both the petitions:

1. Research Details: Our client’s research has the potential to significantly benefit the field of medical diagnostics as it focuses on designing and synthesizing novel ligand complexes and nucleobase analogues for widespread medical and industrial purposes.
2. Publication Record & Citations: The findings from his various research projects has been published in 17 peer-reviewed scientific articles and one book chapter and has helped other researchers from all around the world who are pursuing research in the similar fields. With the help of Google Scholar we concluded that our client’s work had been cited 134 times by his peers.
3. Review Work: Another piece of information that overlapped in both the petitions was the number of times he had assessed the work of other experts in the scientific community. Our client, who is a regular reviewer for leading journals in the field of synthetic chemistry, had conducted 30 reviews at the time of filing the petitions.

All of the above evidence was corroborated by the inclusion of five recommendation letters written by renowned figures in the Field. They urged the USCIS to grant our client the approval so that he can continue his research in the United States. One such recommender—a professor in an esteemed US university—summed up his views on our client’s work with a succinct remark: “We will not find a more capable or accomplished scientist in the field of synthetic chemistry today.”

The adjudication on the EB-1A case was prolonged because the USCIS issued a Request for Evidence (RFE). However, the approval subsequently came through after we effectively tackled it by submitting further documents. We thank him for reposing his trust in our services to help him overcome the first step in the green card process and also for retaining us to help with the second and final step (the I-485 application).
