Case Summary:

A postdoctoral fellow from China engaged the services of North America Immigration Law Group (WeGreened.com) to file an EB-1A (Alien of Extraordinary Ability) Petition on his behalf. With an extensive background in the field of immunology (including a Ph.D. degree), there was no doubt that he was an ideal candidate for the EB-1A visa category. Firstly, we studied our client’s groundbreaking contributions to the field of immunology, more specifically, his discovery of a therapy which halts the progression of auto-immune disorder systemic lupus erythematosus (SLE). We demonstrated to the USCIS that his work has propelled the research on auto-immune disorders to the next level. Additionally, we noted that his current research is centered on immunotherapy approaches to fighting cancer. We collated considerable evidence of our client’s efforts to prove that his consistent findings have led to a global revolution in the healthcare sector.

Additionally, we strengthened our client’s petition by shedding light on his scientific output as a result of both collaborative and individual efforts. We illuminated his outstanding achievements, including the 6 peer-reviewed scientific articles, 1 book chapter, 4 presentations, and the 16 peer-reviews he had conducted for high-impact scientific journals at the time of filing. We also listed his citation record which accounts to at least 166 citations from other researchers.

In order to further enhance the chances of success of our client’s EB-1A petition, we incorporated recommendation letters from several other industry experts. One of them stated: “[Client] is exploring the utilization of the immune system for combatting cancer cells, once again expanding treatment options in an area where they are desperately needed”.

Responding to the RFE:

We encountered several speedbumps along with way to petition approval. It involved responding to a Request for Evidence (RFE) and raising two service requests. Our client even contacted his congressperson twice. Despite the lengthy adjudication timeline, this EB-1A petition approval proved that no matter what, we will do our very best to help our clients achieve success in obtaining I-140 approval. We congratulate our client on this victory as he takes a major step forward towards his dream of obtaining a green card.
