Permanent Residency Requirements for Short Term Stream Visa 482 Holders

In November 2021, the Australian government announced that they would arrange a Permanent Residency pathway for Visa 482 Short Term stream holders. Then on 18 March 2022, the new regulation for the Permanent Residency pathway for Visa 482 Short Term stream holders was released.

The regulation states the requirements and that the arrangement is applicable from 1 July 2022. The new regulation proposes expanding the chance for Visa 482 Short term stream holders to get a permanent residency in Australia.

What are the requirements?

What is the Visa 482 Short Term stream?

Temporary Skill Shortage (subclass 482) visa or Visa 482 is one of the employer-sponsored schemes working visa in Australia. Visa 482 is a temporary visa with 3 different streams, namely:

  • Short-term stream
  • Medium-term stream
  • Labour agreement stream

If you hold a Visa 482 and your occupation is in the Medium and Long-Term Strategic Skill List (MLTSSL), you will have some Permanent Residency pathways, and one of them is by applying for an Employer Nomination Scheme visa (subclass 186). Visa 186 also has 3 different streams; Direct Entry stream, Labour Agreement stream, and Temporary Residence Transition stream.

Generally, to be eligible for a Visa 186 Temporary Residence Transition , you must have at least 3 years of work experience as a Visa 482 holder. The visa 482 holders with occupations in Short-term Skilled Occupation List (STSOL), do not have a direct permanent residency pathway like those who have their occupation on MLTSSL.

With the new arrangement, Visa 482 Short-term stream holders can get permanent residency if they meet the eligibility criteria.

Permanent Residency Requirements for Visa 482 Short Term stream Holders

The new regulation provides a permanent residency pathway for Visa 482 Short Term stream holders, including a pathway by applying for Visa 186 Temporary Residence Transition stream. To be eligible, the visa holders must meet the following requirements:

  • Was granted a Visa 457 (now has changed to Visa 482) after 18 April 2017;
  • Existing visa 482 holders in the short-term stream
  • Reside in Australia for a cumulative total of at least 12 months between 1 February 2020 and 14 December 2021;
  • Be employed by a person actively and lawfully operating a business in Australia when the nomination application is made.
  • Must be working with the same employer for 3 years

The new regulation applies to a Visa 186 Temporary Transition Stream application made from 1 July 2022.

The new regulation means a broader chance to get a permanent residency pathway for you.
