New South Wales Opens the State Nomination for 190 Visa and 491 Visa

With the NSW state Nomination opening, regulations have also been updated. NSW state nomination is now open for 190 Visa and 491 visa applicants. Additionally, the NSW state government decided to open nomination for 190 and 491 offshore visa applicants.

What is the updated regulation?

NSW State Nomination for 190 Visa Applicants

The state uses a selection-based invitation process to ensure that NSW nominees are linked with the state’s economic skills needs. It means you cannot apply for NSW nomination directly. You must be invited and nominated by the NSW state government first before applying for a 190 visa.

The NSW state government now opens the nomination for both onshore and offshore applicants, with only certain occupations for offshore applicants. There are different requirements for onshore and offshore applicants, as seen below:

a. Requirements for onshore applicants

If you are residing in Australia, you must:

• Have genuinely and continuously resided in NSW for the last three months, or
• Be gainfully employed in a long-term capacity in NSW in your specified (or closely similar) occupation for at least 20 hours per week.

b. Requirements for offshore applicants

If you are residing outside Australia, you must:

• Have lived overseas for the past three months, and
• Have a valid skills assessment for a profession within an ANZSCO unit group that accepts offshore candidates.

Additionally, for both onshore and offshore candidates, you must also have a minimum of three years of work experience in your nominated (or closely related) Occupation for all occupations within some ANZSCO unit groups which are identified under the “experience” column on the official website of NSW Skilled Occupation Lists.

NSW State Nomination for 491 Visa Applicants

NSW state government now provides three different streams for the 491 visa nomination criteria. Those streams are:

Stream 1 – If you’re living and working in a Regional Area of NSW

To be eligible for this stream, you must:

• Have a valid skills assessment for an occupation listed on Stream 1 combined occupation list (occupation link below)
• Having spent the previous twelve months living and working in your nominated (or closely similar) occupation in a specified regional area of NSW for a minimum of 20 hours per week.

Stream 2 – If you have recently completed studies in the Regional Areas of NSW

To be eligible for this stream, you must:

• Hold a valid skills assessment for an occupation listed on your preferred region’s occupation list (occupation link below)
• Having undertaken study in the last 24 months in which:
  • You can claim points for ‘study in regional Australia’ on the basis of study in Regional NSW, and
  • Your qualification is assessed by the relevant assessing authority as closely associated to your nominated occupation.

Stream 3 – If you are skilled in an occupation required in the Regional Area of NSW

To be eligible for this stream, you must:

• Hold a valid skills assessment for an occupation that appears on the occupation list for your selected region (occupation link below)

What is the Nomination Process?

The most important thing is that you must meet the criteria for a 190 or 491 visa. There are different state nomination processes for the 190 visa and 491 visa.

NSW State Nomination Process for 190 Visa

• Make sure you are eligible for a Skilled Nominated visa (subclass 190);
• Confirm you meet the NSW minimum eligibility criteria;
• Complete an EOI (Expression of Interest) in SkillSelect;
• Be invited to apply during an invitation round;
• Apply for NSW nomination within 14 days;
• Provide evidence for all points claims in your SkillSelect EOI and where you currently reside.

NSW State Nomination Process for 491 Visa

• Ensure you are eligible for the Skilled Work Regional visa (subclass 491);
• Complete an EOI (Expression of Interest) for occupation available in your preferred NSW region;
• Submit an ROI (Registration of Interest) during a submission window;
• Be invited to apply;
• Apply for the RDA office in your preferred region where your skills are required within 14 days of being invited by NSW;
• Provide evidence with your application for all claims in your NSW ROI and SkillSelect EOI.

You must lodge a Registration of Interest (ROI) to show your interest in working in the NSW regional area. You must submit an ROI during a ‘submission window’. The submission window for the 2021-22 financial year is in January, March, August and October.
