Supreme Court Approved the guidelines spell to protect Humanitarian:

In a verdict on 1stApril, the Supreme Court of India has approved the Centre’s plea about not compelling the person to become a witness in a road accident case, when that person has taken the injured road accident victim to the hospital.

The Judgment came against the Central government’s notification issued on May 2015, that allowed the individuals who brought the road accident victim to the nearest hospital to let go without being asked to pay money or his/her whereabouts.
The New Rule For Road Safety:
  • Now that the Supreme Court has approved the Central Govt. Notification, it may now become the law of the soil. In this matter, the additional Solicitor General Pinky Anand informed the court that the Centre does not possess the power to issue a direction to the states as the Law & Order is a state subject.
  • Now with this approval of the Supreme Court, it may be expected that the number of death due to road accident will decrease as the people will not be under the pressure of revealing their identity or address to the Police.
  • The Supreme Court mandate had another important dimension that after producing the Accident victim to the hospital, the hospital authority cannot detain the rescuers for any reason.  Further, any Government hospital or registered hospital cannot ask for registration fees of admission charges from the rescuer.
  • The Person who brought the victim to the hospital will not have to give his/her address to the Police. He/She may become witness to the accident voluntarily. If that happens, then the rescuer may record his or her statement via video conferencing.
  • In case the persons who became witness to the accident or brought the victim to the hospital, volunteer to visit the Court and depose in the case, then the trial judge is bound to complete his/her examination in one sitting
