1. What are the prerequisites for the registration of an aircraft in Nepal?

All civilian Aircraft must be registered in Nepal and hold a Certificate of Registration, which is issued by the Director General, in order for Civil Operation in Nepal to be successful. Conversely, an aircraft registered in any country other than Nepal is ineligible for operation in Nepal. However, foreign-registered aircraft are permitted to operate in Nepal. In addition, compliance with CAAN and Nepalese Law and Regulations must be guaranteed.

However, they are exempt from the aforementioned registration requirements for the aircraft listed below. Mounted balloons, meteorological pilot balloons, kites, rockets, gyrogliders, parasails, and control line and free flight model aircraft are among them. Furthermore, exemptions for hang gliders and parachutes are granted. Additionally, unmanned aircraft that are operated under the direction of the Director General are exempt, barring mandatory compliance with particular regulations.

An additional restriction pertains to dual registration. An aircraft is ineligible for registration in Nepal if it is not registered in Nepal under any other jurisdiction. Every aircraft operating within Nepalese airspace is required to comply with the regulatory framework established by CAAN.

2. How do aircraft get registered in Nepal? 

The Civil Aviation Authority of Nepal (CAA Nepal) is the governing entity in Nepal with regard to aircraft registration. The Nepalese Civil Aircraft Register is an up-to-date register that must be maintained by it. The necessary application materials for registration are outlined below.

In order to maintain accuracy, the Nepalese Civil Aircraft Register must be consistently revised to include new registrations, ownership transfers, cancellations, and corrections to errors that have been reported. The register is available at the CAA Nepal Department of Flight Safety Standards. Additionally, information from the register may be accessible via the Internet or other appropriate electronic means to the general public.

In Nepal, the denial or cancellation of aircraft registration may be warranted under specific circumstances. In the event that the aircraft is registered outside of Nepal and its registration remains active after registration in Nepal, the Director General retains the authority to intervene.

(a) An individual lacking the necessary qualifications possesses or a portion thereof, the aircraft.

(b) Registration of the aircraft would not serve the best interests of the public.

(c) The Nepalese Army, Nepal Police, and Nepal Customs now hold ownership of the aircraft.

(d) The age or utmost permissible utilisation of the aircraft has been surpassed, as stipulated in the National Civil Aviation Policy of the Government of Nepal.

(e) In accordance with NCAR Chapter B.1, the aircraft does not possess a Nepalese Type Acceptance Certificate; furthermore, there are no intentions to transfer the technology to the staff of the relevant Air Service Operation Organisation or the CAA Nepal.

3. What does the validity of the aircraft registration certificate entail?

The initiation of the aircraft registration procedure occurs when the Civil Aviation Authority of Nepal (CAA Nepal) receives a duly completed application from a qualified applicant. Subsequently, the aircraft is formally documented in the Civil Aviation Registry’s Civil Aircraft Register.

Upon the effective completion of the registration process, the Director General issues a Certificate of Registration to the registered owner. The present certificate accurately reproduces the specified wording and layout. The certificate’s dimensions are ascertained by CAA Nepal. The issuance of the Certificate of Registration is restricted to the English language only.

The registration process and the subsequent entry in the Civil Aircraft Register do not confer or imply ownership of the aircraft in an automatic manner. The Certificate of Registration lacks conclusive evidence regarding the ownership or beneficial ownership interest in the aircraft in question.

The Director General pledges to furnish information to other ICAO Contracting States or to ICAO itself concerning the registration and ownership particulars of any aircraft that has been registered in Nepal, upon request.

When an aircraft is initially recorded in the Civil Aircraft Register as the first of its kind, it is the duty of the Director General to inform the State of Design and/or State of Manufacture regarding the aircraft’s entry into the Nepalese Civil Aircraft Register.

4. What is an aircraft’s registration mark?

The following documents must be submitted to CAA Nepal in addition to the application in order for the owner or operator to request the assignment of a registration mark for an aircraft importation:

9. Date of Manufacture: • Information on the date of manufacture, guaranteeing compliance with the most recent Civil Aviation Policy concerning aircraft age, cycles, hours, etc.
10. Additional Documents as Requested by the Director General: • Any additional documents that the Director General may request.

5. How does one transfer ownership of a Nepalese registered aircraft?

The current registered owner is required to promptly notify CAA Nepal in writing of any modifications to the information submitted during the registration application process, aircraft destruction or permanent withdrawal, or lease termination. A registered aircraft must be delivered to CAA Nepal in writing within fifteen days of the transfer of ownership.

Registration voids and certificate of registration must be returned to CAA Nepal in the event that an unqualified individual acquires ownership of the aircraft or a portion thereof. In order to modify the name or address of the owner or operator, an application must be submitted by the possessor of the certificate of registration.

For aircraft registered in the name of a corporation or company, the required documentation consists of certified true copies of proof of name change in accordance with the Company Act, as well as a voucher redeemable for the applicable charge paid to CAA Nepal for the requested amendment to the Certificate of Registration.

The owner must petition to the Director General with supporting documentation of the new operator’s operating permit/certificate and authorization for continuing airworthiness management when an aircraft is transferred from one operator to another. The transfer of ownership occurs when the Director General receives an application from the current registered owner and designates a new qualified owner.

Included in the Transfer of Ownership Application are:

1. Application submitted in an acceptable format and with the signatures of both the existing and new eligible proprietors.
2. The original copy of the current Certificate of Registration, confirmation of the mortgagee’s concurrence (if applicable), evidence of payment of all debts to CAA Nepal, and a duplicate of the voucher for the prescribed fee must be enclosed with the contract or agreement between the parties.

6. What should be submitted in the Application for registration of an aircraft?

The following information and documents are necessary to register an aircraft and acquire a Nepalese Certificate of Registration:

1. Application (Form B.5.1) Form:

• The name and address of the owner.
• The name and signature of the designated representative, if there are multiple proprietors.
• The name and address of an authorised representative applying on behalf of the owner.

2. Certificate Type (if relevant):

• A certificate from the Director General attesting to the type or adoption of the type.
• Details pertaining to the type certificate and aircraft, encompassing the serial number, manufacturer, country, and year of production, certificate number, and production certificate number.

3. Aircraft Specifications (in the absence of a type certificate):

• The manufacturer or constructor of aircraft, if relevant.
• A variety of aircraft types, including power-driven aircraft, rotorcraft, ornithopter, balloon, airship, and glider.
• Country and year of production, serial number, and model of the aircraft.
• The quantity and type of engines, seating capacity, and land/water utilisation of power-driven aircraft.

4. Registration Mark: • The validity period of any registration marks that may be assigned.
5. Importation Information: • The country of origin of the aircraft.

• A prior registration of the mark in the country of export.

6. Evidence of Cancellation of Prior Registration: • A certificate of non-registration or proof of cancellation issued by the manufacturing state or previous state of registry.
7. Ownership Evidence: • Documentation substantiating the aircraft’s ownership.
8. Contract for Conditional Sales or Bill of Sale: • A duplicate of the contract for conditional sales or bill of sale. • A copy of the lease or lease purchase agreement for leased aircraft.
9. Aircraft Insurance: • A copy of a valid policy of aircraft insurance that the Director General has approved.
10. Fee Remittance: • A duplicate of a voucher in exchange for the payment of the fee specified in the Civil Aviation Regulations, which is required to obtain the Certificate of Airworthiness.
11. Language Certification: • Attestation that the entirety of the aircraft-related placards, instructions, and documents are written in English.
12. Supplementary Data (upon request):
