Judge Mohsin Akhtar Kayani of the Islamabad High Court expressed dissatisfaction with the authorities’ inability to locate fugitive poet and journalist Ahmed Farhad Shah and questioned whether spy agencies should be in charge of the government or the legal system on Monday.

It is said that last week the poet was kidnapped from his home. His wife repositioned the IHC in an attempt to aid in his recuperation on May 15. She also asked the court to find, look into, and bring charges against the people who disappeared with him.

“Hostage [Shah] is not with the Inter-Services Intelligence (ISI),” a Ministry of Defence representative informed the court at the beginning of today’s hearing.

The person went on to state that the ISI was disputing the claim that it was complicit in the poet’s forced disappearance.

“Now that the matter has gone beyond the jurisdiction of the ISI and the Military Intelligence (MI),” the judge said. They are narrating how they failed.

The defence secretary was instructed by Justice Kayani to provide a written report to the high court. The defense and interior secretaries were instructed by the judge to come into court today.

The judge went on to say that he would subsequently call Shehbaz Sharif, the prime minister, and the cabinet members involved in the case.

This is not an easy or simple thing. In this situation, one must lead by example.

“They [spy agencies] are sending messages [to the family], but on the other hand they were saying that the person is not in their custody,” the judge said.

He said that the kidnapped person has not been found by the law enforcement authorities.

The sector commander’s statement must be recorded and turned in to the court on Tuesday, per the investigation officer’s directive from the court.

Judge Kiyani added that in the event if the poet who went missing was a terrorist or was nominated in any event, he would reject the plea.

A second attorney general informed the court that a FIR had been filed and that the police were conducting investigations in the interim.

The judge then questioned if filing a formal complaint was a favor, reminding the additional attorney of the police’s responsibilities.

Media sources state that Justice Kayani stated at the prior hearing that “there is a dire need for a law that entails the death penalty” for anyone responsible for forced disappearances.

In his conversation with reporters at the IHC, AAG Munawar Iqbal stated that the issue concerned kidnapping rather than unlawful detention. The matter was being looked into by the police.

“The court had ruled in the Shehnaz BiBi case that it would not meddle in the investigation.”

He went on, “The court will receive additional assistance in this regard.”
