Withdrawn petition opposing Imran Khan’s Nikah

The plaintiff dropped his case, and on Friday, a court of judicial magistrate in Islamabad dismissed a request demanding action against Pakistan Tehreek-e-Insaf (PTI) Chairman Imran Khan for solemnizing nikah “against Sharia” with his current wife Bushra Bibi.

The petitioner, Muhammad Hanif, had filed a motion in court to file a lawsuit against the former prime minister for allegedly marrying his current wife while she was on iddat. However, he withdrew his complaint, which resulted in its dismissal.

The petitioner stated in a recent court application that he want to withdraw the complaint mentioned above for the time being for technical reasons.

Should authorization to withdraw the complaint be denied, the petitioner will incur irreversible damages.”

Judicial Magistrate (East) Qudrat Ullah concluded the case after approving the withdrawal of the complaint in accordance with Section 248 of the Code of Criminal Procedure (CrPC) in light of the complainant’s statement.

Despite the fact that Bushra Bibi’s Iddat period had not finished, Muhammad Hanif, the petitioner, had alleged that Bushra Bibi was divorced from her previous husband in November 2017 and married Khan on January 1, 2018, “which is against the Sharia and Muslim norms.”

The complainant produced statements to the court from Imran’s close friend Awn Chaudhry, who was one of the witnesses at the wedding, and Mufti Muhammad Saeed, who performed the marriage between Imran and Bushra.

Despite knowing everything, Saeed, who performed the couple’s nikah with solemnity, claimed that the PTI chief wedded Bushra Bibi during the latter’s iddat—the period of time a woman lives alone after her spouse passes away or divorces her.

According to Saeed’s declaration to a lower court, on January 1, 2018, he solemnized Khan’s nikah with Bushra Bibi on the veracity of a woman posing as the former first lady’s sister.

“Then the former premier contacted me again in February 2018 and requested me to solemnise his nikah with Bushra Bibi again as the first time it was against the Shariah,” Saeed said in court.

He maintained that Bushra Bibi’s Iddat had not terminated the first time the nikah was solemnized.

Khan was cited by him as stating that Bushra Bibi had separated from her husband in November 2017 and that a “prediction” existed that the PTI chairman would become Pakistan’s prime minister should he wed Bibi.
