Types of Charges in the Murray Justice Court.
The Murray City Justic Court only handles Class B and Class C Misdemeanors, along with Infractions.
Class B Misdemeanor: Max Jail 180 days. Max Fine $1,000, or community service.
Class C Misdemeanor: Max Jail 90 days. Max Fine $750 or community service.
Infraction: Jail is not possible. Max Fine is $750 or community service.

The following crimes are also prosecuted in the Murray City Justice Court.

(2). Division of Wildlife Resource violations
(3). Infractions, including traffic and parking violations committed within Murray City’s boundaries.
(4). Class B and Class C Misdemeanors committed within Murray City’s boundaries.

Here are some common charges in the Murray Justice Court:

Domestic Violence. Harassment, Domestic violence in the presence of children, threats of violence, DV assault & battery, electronic harassment are a few common domestic violence tagged charges. A total list of tagged domestic violence crimes is found at Utah Code 77-36-1 (Utah’s Cohabitant Abuse Procedures Act.).

There is no actual crime of domestic violence, DV crimes are other crimes that have a domestic violence enhancement.

Cohabitant Defined: To be a crime of domestic violence the alleged criminal action must be against an intimate partner or family member. Cohabitant is defined at Utah Code 78B-7-102. The cohabitant must be 16 years or older to qualify.
All domestic violence convictions are enhanceable offenses. Meaning if you have priors, any new charge is more severe.

DUIs. “DUI like” convictions are many. Utah’s “Driving Under the Influence like” convictions include; Extreme DUIs. Regular DUIs, Drugged Driving. Impaired Driving, Wet Reckless Driving, DUI causing injury, DUI with minors under 16, DUIs 2nd, 3rd and Felony DUI.

DUI Expungement. DUIs have a 10 year waiting period to expunge, compared to 7 years for a felony and 4 years for a Class B Misdemeanor.

Metabolite Driving. Drugged driving charges can be with legal and illegal drugs in your system, so long as you were impaired to drive. You can be taking perfectly legal drugs prescribed by your doctor and within therapeutic ranges and still get a DUI if those drugs impair your driving.

Illegal drugs, street drugs, or otherwise lawful prescription drugs, but you don’t have a prescription for constitute “Per Se” driving impairment. “Per Se” means that is it automatically presumed that you were impaired.

Ultimately it is always a jury question on what constitutes impairment while driving. All “DUI Like” convictions are enhanceable offenses where your next DUI arrest will be charged more severely.

Retail Theft. Retail Theft is an enhanceable offense. Class B Retail Theft is where the stolen merchandise is under $500. Over $500 in stolen goods can be charged as a Class A Misdemeanor. Only Class B Retail Thefts are charged in the Murray City Justice Court.

Alcohol Crimes. There are many alcohol crimes or where alcohol is involved. Intoxication, public urination, disorderly conduct, domestic violence, DUIs, open containers to name a few. See this near master list of alcohol crimes in Utah.
Some alcohol related convictions can suspend your driver’s license. MIPs, DUIs, Interlock, and Not a Drop violations to name a few.

Child Abuse. Misdemeanor B child abuse is prosecuted in the justice court. Child abuse can be recklessly, intentional or knowing. You can’t accidentally commit child abuse.

Drug Possession. Marijuana is still very illegal in Utah. Utah is a medical marijuana state, but as of 2023 combustible marijuana is still illegal. You can’t smoke even medical marijuana. Additionally, you have to keep the marijuana in the same original packaging and out-of-state purchased marijuana is still illegal.

Legal marijuana that you bought in Colorado or Wendover is still illegal in Utah.

Drug Paraphernalia. Utah’s drug paraphernalia act is very broad in how it defines drug paraphernalia. Ultimately it is up to the jury to decide what is drug paraphernalia and what is not drug paraphernalia. Long live the jury.

Who Prosecuted Crimes in the Murry Justice Court?
Outside of conflict cases, the Murray City Attorney’s Office prosecutes all charges filed in the Murray City Justice Court.

The West Valley City Justice Court has 19,376 filings in 2022 and is the biggest justice court in Utah. The Salt Lake City Justice Court has 16,859 filings in 2022.

What is a Justice Court De Novo Appeal?
Because many Utah Justice Courts are still manned by non-lawyer judges, justice courts are not considered “Courts of Record.” Because of this lack of lawyer training in all justice court judges, you always get a full appeal. Appeals to the district court judge is called a “De Novo.” “De Novo” just means do it all over again in the district court.

Appeals from the district court originating in the justice court are limited to constitutional and statutory issues.
