Here is another contribution, or at least another look. I began to become aware of ‘outwork’ when I stumbled across the term in a paper dealing with the grinders in the OT. There is an apparent discrepancy in the Hebrew text regarding the makeup of the workforce. The Israelite miners were not slaves but were paid as ‘wages’. Exodus 5.8 states:

When Pharaoh let the Hebrews go, God sent a cloud-and-thunder storm on the land, and manna fell. On the ninth day, Pharaoh summoned his officials, and he said, “Why have you so let the Hebrews go? I have sinned against the gods, for the Hebrews are now the masters of the land.” (RSV)

According to the Hebrew word ‘yashar’, the Hebrews were workers rather than slaves. How is this possible? (Judges 20.6) God puts the faithless, stupid and feeble in charge of the mines and they carelessly allow the covenant-faithful to simply walk away. That would be like today, if a boss dumped a problem worker and allowed his replacement to simply walk away all unsuspecting of his wrongdoing. He would be like a no-good hireling who thought he was paid for working. He might take advantage of the fact that he would only be paid daily wages- if he was a full-time worker. The Jewish leader Ahi violated the Sabbath, probably like other ancient military leaders. That made him break both the Mosaic and the imperial laws. Was that why he lost control of his troops who had worked the mines during the Sabbath? In a ruling on Monday, the Court of Appeals for the Armed Forces concluded that the commander at Travis Air Force Base in California violated the law by firing a member of the Air National Guard who was forced to deploy to Kuwait for a year during the Iraq War.

This year, the Air National Guard was forced to deploy 200 members to Kuwait because of the ongoing war with ISIS. As Buzzfeed reports, when Maj. Vaughn Stewart was forced to choose whether to serve in Iraq or Kuwait, he picked the latter.

While serving in Kuwait, Stewart was reprimanded after he recorded footage of the deployment on his phone. The footage was deemed a “classic example of a service member using his or her government-issued smartphone to engage in conduct unbecoming an officer.”

After this reprimand, Stewart was ordered to “reassign to Iraq” and did not get an honorable discharge or a reduced rank. While Stewart’s commander, Col. Stephen Swiger, agreed that he could be tried and punished in absentia, after legal challenges Stewart appealed his case.

After reviewing the matter, the Court of Appeals for the Armed Forces ruled that not only did Stewart’s commander inappropriately fire him but that “it is clear that his discharge was unlawful.”
