Are you confused of the difference between bail and a bond?

They are related but not the same.

Bail is a sum of money that a defendant pays to the court in order to be released from jail while awaiting trial. Bail comes in different forms of payment such as:

• Cash or any form of credit
• Collateral such as a home or vechile
• or R.O.R, meaning release on their own recognizance.

A bond is a contract between the defendant, bail bonds company and court. The bond serves as a gaurantee the defendant will appear at all of their court dates. Or the bail bonds company must pay the full amount of bail to the court.

Both the bail and bond work together to ensure the person accused of a crime returns to court. This also allows the accused to continue their life while awaiting trial.

What is the main difference between bail and a bond?

• Bail is paid directly to the court, which can be cash, property, or a combination of both. Bail is a form of payment
• A bond is a contract and not a form of payment

So how does the bail bond process work?

1. First, the defendant or the defendant’s family contacts a bail bond agent or company.
2. The bail agent collects a fee, such as 10 percent of the total bail amount.
3. The bail agent then posts the bond to secure the person’s release from jail and gives the court the percentage of the bail total amount.
4. If the person doesn’t show up in court, the agent is responsible for the full bail amount. Meaning, in this example the rest of the 90% of the total bail amount.
