Google’s Settlement in Incognito Tracking Lawsuit

Google has reached a settlement in a lawsuit accusing it of secretly tracking users’ internet activity in private browsing mode.

Google’s Incognito Tracking Lawsuit

Google has agreed to settle a Lawsuit claiming it secretly tracked the internet use of millions of people who thought they were browsing privately. The plaintiffs alleged that Google’s analytics, cookies, and apps allowed the company to track their activity even when they set Google’s Chrome browser to incognito mode and other browsers to private browsing mode.

Settlement Details

US District Judge Yvonne Gonzalez Rogers put a scheduled February 5 trial in the proposed class action on hold after lawyers for both sides reached a preliminary settlement. The terms of the settlement have not been disclosed, but the lawyers expect to present a formal settlement for court approval by February 4th. The lawsuit had sought at least $US5 billion ($7.3 billion) in damages.

Legal Proceedings

In August, Judge Rogers rejected Google’s bid to dismiss the lawsuit, citing Google’s privacy policy and other statements by the company that suggested limits on what information it might collect. The lawsuit, filed in 2020, sought at least $US5,000 ($7,314) in damages per user for violations of federal wire-tapping and California privacy laws, covering ‘millions’ of Google users since June 1st, 2016.

Recent Legal Issues with Google

This is the second lawsuit Google has been involved in this month, as Fortnite publisher Epic Games recently won an antitrust lawsuit against Google over its alleged illegal monopoly on the Play store.
