Police ‘had key DNA evidence 16 years before Andrew Malkinson cleared of rape’

Andrew Malkinson, who spent 17 years in prison for a rape he did not commit, had his conviction quashed last month after DNA evidence linking another man to the crime was discovered. Case files have revealed that police and prosecutors knew in 2007 that another man's DNA was found on the victim's clothes, but they took no further action and did not inform the body responsible for investigating miscarriages of justice. The Criminal Cases Review Commission (CCRC) refused to order further testing or refer the case for appeal in 2012, citing concerns about costs.
