Section 498A of IPC Initially Enacted to Curb Husbands’ Cruelty, Now Being Misused: Jharkhand HC

The Jharkhand High Court has observed that Section 498A of the Indian Penal Code, which was Initially Enacted to address cruelty inflicted by husbands or their relatives, is now being misused. The court was considering a plea filed by a husband and his relatives seeking the quashing of criminal proceedings initiated against them. The court clarified that it has not interfered with the complaint case or the order taking cognisance against the husband, and the trial against him will proceed. The court noted that there were general and omnibus allegations against the relatives, and therefore, the order taking cognisance against them was quashed.
