Attorney General Brown Backs Federal Legislation Prohibiting Individuals with Felony Convictions from Owning Guns

In a separate case known as Bianchi v. Brown, the Office of the Attorney General defended Maryland’s Firearm Safety Act in front of the U.S. Court of Appeals for the Fourth Circuit. This law, enacted in 2013, prohibited assault weapons in Maryland following the tragic 2012 mass shooting at Sandy Hook Elementary School in Newtown, Connecticut.

Maryland Attorney General Anthony G. Brown recently teamed up with 21 other attorneys general to submit a legal brief supporting the federal law that bars individuals with felony convictions from owning firearms. The coalition, in their brief for U.S. v Prince, is urging the U.S. Court of Appeals for the 7th Circuit to reverse a previous ruling that deemed the law unconstitutional.

“Keeping guns out of the wrong hands is vital to protecting and improving public safety,” said Attorney General Brown. “I am committed to upholding common sense Gun Safety Laws, including laws preventing people with felony convictions from having access to these deadly weapons.”

The coalition asserts that the Second Amendment permits governments to implement reasonable and diverse regulations to safeguard the public. Nearly every state in the nation has imposed restrictions on firearm possession for individuals with felony convictions, in addition to federal law, with many states upholding these laws for close to a century. The attorneys general further clarify that while the current federal regulation sets a clear and feasible standard, any alternative approach would be cumbersome and nearly impossible to enforce.

In a separate case known as Bianchi v. Brown, the Office of the Attorney General defended Maryland’s Firearm Safety Act in front of the U.S. Court of Appeals for the Fourth Circuit. Tomorrow, in the same court, the Office will defend another law aimed at enhancing public safety - a requirement for most individuals to obtain a license before purchasing a handgun - in Maryland Shall Issue v. Moore. Both hearings in the Fourth Circuit are rehearings before the full court of cases previously heard by three-judge panels. Attorney General Brown remains committed to vigorously defending sensible gun safety laws to ensure the safety of Maryland residents.

By submitting today’s brief, Attorney General Brown stands in solidarity with the attorneys general of California, Colorado, Connecticut, Delaware, the District of Columbia, Hawaii, Illinois, Maine, Massachusetts, Michigan, Minnesota, Nevada, New Jersey, New Mexico, New York, North Carolina, Oregon, Pennsylvania, Rhode Island, Washington, and Wisconsin.
