The parents of a 9-year-old Florida boy are suing the city of Oviedo and local police after their child was handcuffed during a violent outburst at school. The incident was captured on body cam footage and released to the public. The child, who is a special needs student prone to outbursts, had a specific procedure in place at Stenstrom Elementary School. The school staff were instructed to limit their attention and only have the child complete tasks. However, on February 2nd, the school staff called the police when they were unable to deescalate the situation. In the body cam footage, the child can be seen throwing mail at Officer Yashira Moncada, who called for backup from Officer Scott Moseley. Despite being advised not to do so, Moseley handcuffed the child, causing him to lay prone on the floor. The parents are seeking at least $75,000 in damages and are accusing the city and officers of excessive force and battery. The lawsuit argues that the child experienced physical and emotional abuse, mental anguish, violation of rights, humiliation, and medical expenses. The lawsuit also points out that handcuffing disabled students in fifth grade or below is prohibited by the school resource officer agreement and an Oviedo Police Department general order. The city of Oviedo has not made any efforts to address the situation, according to the family’s attorney. An investigation is ongoing to determine the cause of the child’s violent outburst.
