Wannabe police officer with post-natal depression sues Police Scotland for discrimination after force rejected her application when she revealed she was taking medication for the condition.

Laura Mackenzie applied to join Police Scotland in June 2019 and was described as an impressive candidate by her recruiting officer. However, after disclosing that she was taking anti-depressants for post-natal depression, the offer to sign up was rescinded. Police Scotland may now face multiple legal cases due to an outdated rule that requires probation officers to be free from medication for two years.

Ms. Mackenzie, who is currently training to be a nurse, is suing the force for discrimination. She received a provisional offer of employment in November 2019, with the condition that she be certified by a registered medical practitioner to be fit physically and mentally for the role. During a medical examination, she disclosed that she was taking an anti-depressant drug, which led to the revelation of the “two year rule” for probationary police officers.

An occupational health nurse acknowledged that the policy was outdated and in need of revision. Despite being outside the usual time limit for making a complaint, an employment tribunal has ruled that Ms. Mackenzie’s case can proceed. Police Scotland’s attempts to appeal the decision have been unsuccessful.

The case has attracted significant public interest, with others coming forward with similar experiences. A full hearing is expected to take place next year. Police Scotland has recently announced initiatives to address mental health stigma and discrimination within the force.
