EACC recovers public land worth Ksh 150M grabbed from KBC

Ethics and Anti-corruption Commission (EACC) has recovered public worth Ksh 150 million grabbed from the Kenya Broadcasting Corporation (KBC) in Mombasa.

The case which is set for hearing in regards to asset recovery saw the land in contention preserved for extension by VoK, the predecessors of KBC.

“Justice Nelly Matheka has granted EACC orders preserving public land worth Kes.150M grabbed from the Kenya Broadcasting Corporation in Mombasa pending hearing of the recovery case. The land was reserved for the extension of VoK, the predecessor of KBC,” said EACC

Francis Waiganjo Kimanga, Lucy Wanjiru Kimanga, and their company Kensko Agro Produce Ltd were accused of fraudulently obtaining the land from former Commissioner of Lands Wilson Gachanja who has also been sued in his personal capacity.

“In the suit, EACC has sued Francis Waiganjo Kimanga, Lucy Wanjiru Kimanga, and their company Kensko Agro Produce Ltd which was fraudulently allocated the land by former Commissioner of Lands Wilson Gachanja. The named Kimangas are the Directors and shareholders of the company.

The former Lands Commissioner Wilson Gachanja is sued in his personal capacity on account of fraud, illegality, and acting beyond his powers. Owing to his conduct, the KBC property has been illegally put to private use and rendered unavailable for the intended public purpose.

EACC wants the Court to declare that all the transactions relating to the allocation and sub-division of the KBC land were fraudulent, illegal, null and void, and incapable of passing any lawful right, title, or interest over the property to the Defendants or any other person,” said EACC
