Court dismisses Kidero’s application to stop Ksh 58M EACC civil suit

The Court of Appeal has dismissed an application by former Nairobi Nairobi Governor Dr. Evans Kidero to stop a Civil Suit Filed by the Ethics and Anti-Corruption Authority (EACC).

In the application, the former Governor was seeking to stop a Ksh 58M alleged embezzlement that happened during his tenure as the county boss.

“The Court of Appeal (Okwengu, Ochieng & Mativo JJA) has dismissed an Application by former Nairobi Governor Evans Kidero seeking to stop a civil suit filed by EACC to recover Kes. 58 million believed to have been embezzled from Nairobi City County.” Said EACC

According to the commission, the case will act as a good precedent in regard to similar applications they have made against the same parties.

“The ruling creates a good precedent given the many petitions and Judicial Review Applications that EACC faces in the event of concurrent civil and criminal cases against the same parties. The decision will, in effect, reduce the time taken in the disposal of anti-graft cases.” said EACC
