Patna High Court dismisses PIL seeking enquiry into illegal felling, sale of trees at cremation ground in Vaishali

The Patna High Court dismissed a Public Interest Litigation (PIL) filed seeking direction to the respondents to conduct an enquiry into the illegal cutting and selling of nine trees in the Cremation Ghat and one tree in the Government Navsrijit Primary School in Ward No.2, Gram Panchayat Maudah Bujurg, Block- Patepur, Circle-Patepur, District-Vaishali.

The PIL has been filed by one Abhay Singh.

The Forest Divisional Officer, Vaishali is said to have taken cognizance of the cutting of trees.

The Division Bench of Chief Justice K. Vinod Chandran and Justice Partha Sarthy held that there is nothing stated in the petition as to how the cutting of trees would be illegal, except for the bland averment that twenty years back, these were planted for the benefit of environment and good health.

It is further alleged that the Mukhiya of the Gram Panchayat, Maudah Bujurg has sold the trees illegally, who has not been impleaded in the official capacity or in person.

The Court, while observing that the petition lacks bonafides dismissed the PIL.
