Supreme Court Toughest Judgement Brings Mixed Responses

As Hindus rejoiced over the unanimous decision by the SC judgment bench, Muslims & other religious leaders expressed mixed reactions. In view of any probable protests or processions, Sec 144 has been imposed in major cities such as Uttar Pradesh, New Delhi, Mumbai, and Jammu & Kashmir for 24 hours following the decision. This section bars people in a group of 4 or more to assemble in public.

SC also mentioned the damage, desecration & demolition of Babri Masjid in previous years as Illegal Acts. The grant of five acres of land for a mosque in Ayodha was awarded to balance the same.

Political leaders have urged the people to respect the verdict and to show faith in the Judgement. The judgment bench stated that Hindus & Muslims both had a competing right over the disputed site. However, the continuous worship of Hindus for centuries gave them better evidence of its connection with Lord Rama.

The Rise of Communal Tension between Hindus & Muslims: 1528-2019

The disputed site, earlier Babri Masjid, is said to be built on the orders of the first Mughal emperor in India named Babar in 1528. Since then, Hindus had started their claims that this site was earlier a Ram temple, also the birth spot of Rama.

Decades Later, in 1853 began the intense communal clashes over the site. This went throughout the ruling of the British Government in India for about 90 years.

Mosque or Temple? Communal Conflicts cause tragic consequence for Babri Masjid

In 1934, Hindus and Muslims fought for the inner courtyard of the Babri Masjid, which led to communal conflict. As a result, the domes and structure of the Babri Mosque were damaged. Two years after the Indian constitution was set up, the Babri Mosque was desecrated by keeping Idols inside the mosque on December 22, 1949.  Therefore, the conflicting parties filed civil suits. Finally, the government put a lock to the Mosque’s gates and declared it disputed. In 1984, many Hindu groups spearheaded by political leaders caused a mass movement to liberate the alleged “birthplace of Lord Rama”. 2 years later, the District judge ordered the mosque gates to open for Hindus to worship Lord Rama. This further led the Muslims to form the Babri Mosque action Committee in protest. Over the years, communal tension and protests rose also. On December 6, 1992, the leading Hindu & political groups demolished the Babri Masjid. This gave rise to nationwide communal riots between Hindus & Muslims.

Indian Judiciary looms around the Hindu – Muslim Tussle

The Prime Minister set up an Ayodhya cell in his office in 2002.  Senior officials intervened to hold talks between 2 opposing groups. After the demolition of Babri Masjid, on December 6, 1992, there has been a significant rise in communalism between the Hindus and Muslims. This has led to riots in various regions, including the Gujarat Riots in 2002.

More lawsuits and arrests followed over the years with archaeological surveys done to find the evidence of claims. In 2010, the Allahabad high court divided the title of land into three equal parts. First, the Hindu Mahasabha, second the Sunni Waqf board represented by the Muslims and thirdly, the Nirmohi Akhara.

Dissatisfied with the decree, the Hindus and Muslims appealed to the Supreme Court. After a series of hearings and charges over the years, SC delivered the final judgment on November 9, 2019.
