Introduction about eviction laws and attorney

An Eviction is the removal of the Tenant and his possessions  from rental  property and home by his landlords.According to the terms of law,  eviction may also be known as unlawful detainer, summary possessionsummary dispossess,summary processforcible detainer, ejectment, and repossession and eviction is the usually used in terms between the landlord and tenant.

The following are the process in eviction

1. Giving notice to the tenant to leave the property

2. If the tenant fails to leave the property, filing a lawsuit to evict the tenant and regain possession of the property and appearing in court.

3. If the tenant still remains in that property, via legal action tenant are forcefully removed

Notice period:

Generally the landlord must give written notice to the tenant to pre introduction about eviction methods. The notice to vacate may either be conditional  or unconditional.

 Conditional :The tenant may remain in the property, if certain actions are taken prior to the specified date

Unconditional: The tenant cannot do anything to avoid the eviction and must leave by a specified date.

Lawsuit and Trial:

If the tenant remains in ownership of the property after getting notice, the landlord would then provide the tenant with a lawsuit. The tenant may be required to submit a written response by a specified date, after that trial date will be announced

If the tenant does not come to trial, automatically landlord will win. Appearing in court, the tenant may share side of the story, such as the landlord not giving proper notice to vacate. If the attorney  sides with the tenant, the tenant remains in the property, but the attorney may still order any past due rent to be paid and also fees and costs.

The eviction attorney process, in New york and Brooklyn cites are two ways in which a landlord may seek to evict a tenant:

1. Through the summary eviction process 

 2. The “formal” eviction process.

In India, the eviction process includes 

1. Not paid the agreed amount on time,then it may due amount 

2. Allowed someone else to occupy home or property without the consent.

3.Used building for any other purpose is consider to be immoral by law

4.Occupied home or property is more 6 month is on under question 

In spanish, the eviction rules are too tough on homeowners. Several suicide attempts are blamed on these eviction issues 

Spanish homeowners under threat of repossession cannot stop the eviction process
