In a recent ruling, the Supreme Court has declared that Ododo, Adeyemi's fate will be determined on October 3rd.

The Supreme Court has scheduled October 3rd as the date for delivering its judgment regarding an appeal filed by Senator Smart Adeyemi. The case challenges the manner in which the primary election of the All Progressives Congress (APC) for the Kogi state governorship race was conducted on April 14th.


Ahmed Ododo emerged as the chosen candidate of the All Progressives Congress (APC) at the Primary Election held in Kogi State. He will represent the party as its flag bearer in the upcoming gubernatorial election scheduled for November 11.


Nevertheless, Adeyemi is questioning the legitimacy of the primary election based on the assertion that key articles of the Electoral Act and the criteria set forth by the APC were compromised during the aforementioned electoral process.


Adeyemi's attempt to invalidate the primary election was unsuccessful in both the Federal High Court Abuja and the Court of Appeal, prompting him to appeal to the highest court.


Adeyemi, the representative of Kogi West senatorial district in the Senate, asserts that the outcome declared by the APC in support of Ododo is illegitimate and void due to the limited scope of the primary poll, which was conducted solely in 11 out of the 239 wards within the state.


During the appeal hearing held on Thursday, Musibawu Adetumbi, a Senior Advocate of Nigeria (SAN) and lawyer representing Adeyemi, presented his arguments by adopting his written submissions. Adetumbi respectfully requested the Supreme Court to grant the requested reliefs on behalf of Adeyemi.
