Court orders the freezing of Ksh.537M in assets owned by a City Hall official earning Ksh.21K per month

The High Court has placed a freeze on the possessions worth 537 million shillings that belong to a City Hall officer who takes home 21,000 shillings per month.

The assets consist of 10 automobiles as well as nine outstanding plots of property located in Siaya and Kisumu counties. One of the parcels of land has a luxurious hotel on its premises.

After Michael Auka Ajwang, a purchasing officer for Nairobi County was unable to adequately explain the source of his undisclosed income to the Ethics and Anti-Corruption Commission (EACC), Justice Esther Maina made the decision on Wednesday.

An order of protection that Maina also granted prohibited Ajwang and Hydeout Riviera Limited, a company that the defendant is associated with, from transferring and disposing of the aforementioned assets.

It has been decided that Ajwang and Hydeout Riviera are not permitted to claim the sum of Ksh. 799,000 that was taken from their accounts by the EACC.

The judge, Maina, handed down a ruling that stated, "Awaiting the outcome and hearing of this suit, an interim injunction has been granted restraining the Defendants/Respondents by themselves, their servants, agents, or any other individual from demanding Kshs. 799,000 seized pursuant to a search carried out by the Plaintiff/Applicant in Miscellaneous Criminal Application Number E1773 of 2022."

The orders will continue to be in effect until the matter is completely heard, at which point a decision will be rendered.
