What Are Design Patents? Design patents are issued by the USPTO for any new, original, ornamental, industrial, utilitarian, or artistic design. Designs protected under patent law are called “patented designs.” How Do You Apply For A Design Patent? There are two ways to apply for a design patent: through the U.S. Patent & Trademark Office (USPTO) website or through an attorney. If you decide to go with the USPTO, you will need to submit a provisional application first. This means that you must pay a fee to file the application. After you receive approval, you will then need to pay another fee to file the final application. What Happens After The Application Process? Once you have filed your application, you will receive a notice of allowance or rejection within six months. You will also receive a certificate of registration after the application has been allowed. What's Next? After filing an application, you must pay a fee and submit additional materials to the U.S. Patent & Trademark Office (USPTO). If you are granted a patent, you will need to pay fees every year until the patent expires. What Are Designs Patents?
