A fatal Train Accident occurred today near Apex, Nevada, along the Caliente Subdivision. This is north and east of Las Vegas, heading out on Interstate 15 if you were going by car. The woman killed in this in fatal Nevada train accident was from Las Vegas. She was said to be 51 years old. The Clark County coroner, who is the investigating agent in this case, determined the death to be a suicide. We will continue to use the term “accident” to describe the incident until and unless the family accepts this to be the case. It’s possible they would or could open an investigation of their own, and find additional evidence that would change the finding released by the Clark County coroner. Out of deference to them, we will pass no judgment which using a word other than accident might ascribe to the case.
Benson & Bingham Attorneys at Law know that what the coroner or the police determine is not always the case. We have great respect for our friends in uniform, and for the professionalism of in related fields such as the coroner. However, we also know that there may be additional evidence that those agencies miss. The coroner, not knowing any back story, might a piece of evidence that a family member could bring to light. This isn’t CSI or NCIS or Bones – they don’t go over every inch of a person and run every test or pull fibers and run the mass spectrometer on the debris under a person’s fingernails every single time. They’re also human, and occasionally just make unintentional errors. Police do the same when investigating Las Vegas car crashes – sometimes their initial determination of fault is just one eyewitness or video clip away from being completely overturned.
