U.S. District Judge William Alsup said Thursday he wasn’t sure whether to dismiss a consumer class action over Trans Fat disclosure in ConAgra’s Fleischmann’s brand margarine and vegetable oil products, saying he wished the Ninth Circuit would rule on whether federal regulations preempt state law in a similar food labeling suit.
