Movie piracy laws in India And World

Not only in India, but in any country with the judicial system, obtaining a pirated copy of copyrighted material would be seen as an offense and will be treated equally.

Unfortunately for India, we were very used to download movies and series from torrent sites without any hurdles for the last few years. To save money and see the newly released movies as early as possible people need not bother to think for a second before downloading the pirated copy of the release from torrent.

There were no restriction and no governing body was taking the responsibility of banning these sites (In between some of the sites were banned, but they were again up in few days). And as a result torrent sites flourished in India. That is why when now the government has banned these sites, it is hard to digest the fact that it is illegal.

Keeping the laws aside if you think morally, downloading a pirated version of 2-hour long movie for which 1000s of people (Yes, it takes 1000s of people to make 2-hour long movie which gets judged on its entertainment quotient) have literally poured their blood and sweat and tears, is just wrong. In simple terms, piracy is theft. And occupying the stolen item without the consent of the owner is also a theft.

The fight against piracy was going on for years in the industry. But due to an incompetent government, it was never taken seriously. Recently, some of the big-budget movies got leaked. Maanjhi, Udta Punjab and Kabaali (Seriously Kabaali? Man, you don't do that with Rajhni sir.. Yanna Rascala!!) are some of the unfortunates and it has stoked the fire.

When this was happening in India, On 20th July, the United States Department of Justice arrested the owner of site Kickasstorrents and the domain was seized resulting in a complete shut down of the site. (Kickass was the most visited torrent site and was blocked in many countries, but every time it came up with the new domain name.)

So, it seems that it was inevitable for torrent sites to run out of the hands of law every time. They will probably come up with the new domain names soon, but I think the fist has clenched their throat and it is just a matter of time they get choked in their own air. Brother, The time to say 'NO TO PIRACY' for real has come.

On a lighter note, the government has still not made clear on how are they going to monitor the billions of connections across the country and how are they going to prosecute the offender.

Personally, I feel a little saddened by the fact that I will not be able to see movies from my 'to-watch' list. I do feel that the industry should create a common portal, where they upload a decent print after a few months of the release. I know a proposal is little hypothetical but after its business is done there is no harm in distributing the copy for letting see it to common people with mere prices. It's an art. For those who want to study it, get inspired by it, shall be available for them at least.

Section 63 makes knowingly infringing or abetting copyright in a work an offense.

When does an Infringement happen?

When any person,

make copies of;
translates;
distributes;
creates modes and adaptations
of any work without the permission of the person who has got the exclusive right to do any or all of the above acts.

• Section 52 of the Copyright Act lists the exceptions to infringement of copyright. One of those exceptions include Fair Dealing, It is not defined what constitutes Fair dealing. So, if a person privately uses it, it may not amount to an offense under Section 63.
• Section 63-A Provides for Punishment of offense mentioned in 63, thus clearly not applicable here.
• Section 65 talks about a duplicating instrument ( Plate ) intended for reproducing copies of any work. Hence provision does not apply to view or download movies or songs from a torrent site.
• Section 65A talks about cracks used for installing pirated software. Any person using a crack to gain illegal access by defying licensing requirements is liable under this provision.

1. No new law has been introduced in regards to copyrighted content so nothing has changed.

2. The govt is trying to scare you via such messages just like every new law student tries to show off with I will drag you to court dialogue.

3. The news report cited in the question description is factually incorrect and misleading. Even Islamic State cant prosecute you for just viewing a TORRENT file or a blocked website (unless it is child pornography).

Let me tell you a fun fact. The distribution of porn is ILLEGAL in India. So every time, you pass on that pen drive or hard disk with the hidden folder, you are committing a crime !!!

Now, coming back to your question…. you are basically scared that the next time you type game of Thrones S07E01 in a torrent site, will police come knocking at your door?

My answer is highly unlikely.

Downloading copyrighted material/intellectual crap has always been a criminal offense, whether it is Captain America or Sultan, be it Eminem or Shri Yo Yo Honey Singh.

Govt. is just sort of trying to scare you via writing it on redirected web pages and propagating it through media. It doesn’t matter whether you listen to an Arijit Singh song itself on a song site hosted in Pakistan or you download it and then listen to it on your phone. You have always been a god damned criminal.

The article is factually incorrect on several accounts. Viewing a torrent file does not tantamount to crime because it is not copyrighted artistic stuff. Nor does viewing a blocked website. There are several websites having adult content or which are critical of the govt and hence have been blocked. If I visit any of those websites, do I commit a crime? NO. Unfortunately, the article has not cared to explain which law does it actually violates if it does in the first place.

Besides the govt usually does not act by itself. The person whose content has been stolen has to file a complaint first.

In case of the content of foreign origin such as Captain America: Civil War or Game of Thrones, assure yourself that nothing will happen. The creators (Marvel Studio or HBO) know that the number of fish is so huge that even if they make an example of 5–10 people, there will be no impact whatsoever.

Besides, their content is so awesome that people can't just wait for it and rather prefer to pay than to wait for the torrent. And the foreigners also have such a good image of the Indian legal system, that they prefer to stay away.

However, Indian distributors can go after you. They have all the time and resources but still, they prefer to back down fearing a public backlash.

TORRENTS ARE LEGAL

As found in the comments section, a lot of people have misconceptions about a torrent file. Unfortunately, this article is only adding to the confusion. A torrent file essentially contains the metadata and trackers info of the file to be shared.

In layman terms, a torrent file contains all the info of the file you want to download (such as its size, file format) and the addresses where you can find the file. In short, it only points to its location.

Many software such as all Linux based OS is distributed legally through torrents. Many paid software also allows you to download them through torrents if u have bought their license. I can send a family video to a relative over the torrent network.

Torrents are highly beneficial in countries like ours where uninterrupted power and the Internet is a distant dream as it saves you from the pain of downloading the file all over again. If you download a torrent file for a movie, it's still not a crime.

But once you start downloading, it becomes an offense. In other words, having a piece of stolen jewelry is a crime but no one can book you for having a chit containing the location of stolen jewelry.
