Power to Give Consent on Land, Delegated by Lagos State Governor, Mr. Babajide Sanwo-Olu to five Commissioners.

Did you know that the power to issue Certificate of Occupancy, Right of Occupancy, Governor’s Consent amongst other sundry powers relating to land and property conveyancing can also be delegated by the Governor of a state in Nigeria?

This was what the Governor of Lagos State, Mr Babajide Sanwo-Olu by virtue of Legal Notice (NO. LN/BOS/001 of 2019) just did!

According to the Notice, which was dated 25th September 2019 but came into operation on the 20th of September 2019, and may be cited as the Land Use Act (Delegation of Powers) Notice No. 001 of 2019, provides that the powers specifically listed in Schedule 1 to the Notice have been delegated to the following commissioners:

  • The Honourable Attorney General/Commissioners for Justice, Mr. Moyosore Onigbanjo SAN;
  • The Commissioner for Water Resources and Environment, Mr. Tunji Bello;
  • The Commissioner for Youth and Social Development, Mr. Segunn Dawodu;
  • The Commissioner of Tourism, Arts, and Culture, Mrs. Shulamite Adebolu; and
  • The Commissioner for Establishment, Training and Pensions, Mrs. Ajibola Ponnle.

The above delegation is in line with the statutory provisions of Sections 21 (a), 22, 23, 45 (1) of the Land use Act, Cap. L5, Laws of the Federation of Nigeria 2004. Section 45 (1) specifically provides:

“S. 45. (1) The Governor may delegate to the State Commissioner all or any of the powers conferred on the Governor by this Act, subject to such restrictions, conditions and qualifications, not being inconsistent with the provisions, or general intendment, of this Act as the Governor may specify; (2) Where the power to grant certificates has been delegated to the State Commissioner such certificates shall be expressed to be granted on behalf of the Governor.”
