POWER OF ATTORNEY ON LAND TRANSACTIONS IN NIGERIA. (LIFE SPAN)

There are situations where the owner of land would commission another person to help him either sell or manage his property. In doing so, he can appoint him with a power of Attorney, to empower him to able to sign the deed of conveyance on his behalf.

In this edition, we shall explore the law on a land transaction made with a power of Attorney and whether such power of attorney given by a deceased person can be acted upon by the Donee upon his  death.

Definition of Terms:

To be able to properly understand the issues to be discussed in this edition, it would be apt to “break down” some of the legal terms used. Such terms include:

  • Power of Attorney: a power of attorney is a legal document whereby one person called the Donor, empowers another called the Donee to act on his behalf, in some transactions in land transactions and other things.
  • Donor: This is the person who owns the land and who his appointing another person, to act in his or her place.
  • Donee: This is the person that has been appointed to act for some other person i.e. the Donor.
  • Deed of conveyance: This is a legal document prepared by a lawyer and which is signed by both the buyer and seller of a landed property, to show true ownership.

Reasons for Power of Attorney:

There a lots of reasons why an owner of a house or land would give authority for another, to act on his behalf in such Transactions. Some of the reasons are:

  • Nigerians in Diaspora: a lot of Nigerians living abroad has made useful investment in landed properties in Nigeria. Now, while they lie overseas, it would be a wise decision to appoint a trusted hand, who can effectively manage those properties on behalf of such an owner. To effectively do this, he would give a power of attorney to such a person, specifying his area of power.
  • Skills and Expertise: it is a wise decision to appoint persons who are well skilled in any particular field, to help manage some transactions on your behalf. By so doing, you protect yourself from the danger of ignorance.
