Govt faces Oppn fire over Criminal Laws Bill

Jaipur: Amid criticism and apprehensions in various quarters, Vasundhara Raje government on Monday tabled the Criminal Laws (Rajasthan Amendment) Bill in the assembly.

Uproarious scenes were witnessed when home minister Gulab Chand Kataria tabled the Bill as Opposition Congress walked out of the assembly. Senior Bjp Leader Ghanshyam Tiwari and another senior legislator also opposed the Bill. Chief minister, Vasundhara Raje was present in the house while the bill was tabled.

At the 9th assembly session, the Bill that amends the Criminal Code of Procedure, 1973, and bars the media from naming the public servant till the Rajasthan government allows the case to be investigated.

The deputy leader of the Opposition, Ramesh Meena, raised objection to the Bill and uproar followed. Similarly, Independent MLA Manik Chand Surana through a point of order opposed it, saying, there was no prior sanction of the President to the Bill which was circulated among the members last night.

Terming it as ‘Kaala Kanoon'(Black law), he claimed that the state government was trying to impose an undeclared emergency through it.

Responding to senior legislator Surana, the home minister said that the merits and demerits of the Bill would be discussed during the debate and that the Bill would become a law only after it was passed by the House.

While the Bill was tabled, senior BJP leader and Sanganer MLA Ghanshyam Tiwari raised ‘point of order’ and requested the speaker to allow him to speak on the Bill. While he was expressing his opposition to the ordinance, the speaker disallowed him and Tiwari preferred to walk out.

While he was trying to speak, Govind Singh Dotasara, Congress MLA from Laxmangarh, remarked, “Let him speak. You have not made him a minister.”

Responding to it, Rajendra Rathore, parliamentary affairs minister, asserted that Tiwari is a respected and senior BJP leader.

Tiwari also warned of a sit in dharna in the Well of the House if he was not allowed by the Speaker to raise his point, but the Speaker ignored him following which he staged a second walkout.

Amid the uproars, the Congress legislators raised slogans against the government and the Bill in the assembly.

“We will oppose the Bill strongly as we find it an attempt to shield the corrupt officials,” said leader of opposition and senior Congress leader Rameshwar Dudi.

Meanwhile, Kataria said that the Bill was introduced and tabled in the assembly because the government wants the opposition to discuss and understand it properly.

It may be recalled that the state government through an ordinance, Criminal Laws (Rajasthan Amendment) Ordinance, 2017, made amendments in Criminal Procedure Code, 1973, and Indian Penal Code, 1980, in September this year. The Bill has certain provisions to restrain the courts to order an investigation against a person, who is or was a judge or magistrate or a public servant, in respect of the act done by them during the discharge of their official duties. It also bars the media from reporting on such accusations till the sanction to proceed with the probe is given by the government.

Three more bills were also tabled in the House before the session was adjourned for the day.
