HGV DRIVER INJURED BY METAL STRIP ON TRAILER RECEIVES PERSONAL INJURY COMPENSATION

Our client was a lorry driver who was delivering frozen goods to a supermarket store.  As our client moved some pallets out of the freezer compartment in his trailer, a Loose Metal Strip on the freezer door sprang towards him and hit him in the eye.  He sustained injury to his left eye in the form of a scratched retina, which caused his eye to swell up and he suffered severe symptoms for nearly four weeks after the accident.  We were able to recover Personal Injury compensation for him of £1,800.

A brief summary of events is set out below.

Date of Accident:  January 2014

Time between formal instruction and successful conclusion:  We took on the case in September 2014 and managed to settle it just five months later in February 2015.

How the claim proceeded:  Once we had received full instructions from our client, we contacted the opponents with his claim.  We received a response from the opponent’s insurers almost straight away admitting a breach of duty, but not admitting that this caused our client’s injury.  We therefore instructed a medical expert to prepare a report detailing our client’s injuries, treatment required and progress of his symptoms, which then enabled us to value his claim.  We then submitted all of our evidence to the opponent’s insurers in order to negotiate a settlement.

Were Court proceedings necessary?:  No.  The opponent’s insurers responded to our offer, with one which was slightly less than our original valuation, but which our client was happy to accept.

Outcome:   The client secured £1,800 for his injuries and received his financial compensation just six months after we took on his case!

Comment:  Employers have a responsibility to ensure that employees are safe whilst using items of work equipment.  In this case the employer breached these regulations, along with other employees who had previously used the trailer and who were negligent in failing to report the loose Metal Strip on the freezer door.
