DRIVER IN HEAD ON COLLISION RECOVERS COMPENSATION

CASE HISTORY

How the Accident Happened

In November 2005 a driver was on an A road when a vehicle travelling in the opposite direction crossed over the central line causing a head on collision.

The Injuries

The driver suffered with pain in his neck and shoulders that lasted for many months, an Injury to a finger causing significant pain for around 8 weeks and a reduction in the grip with that hand for about 6 months, and also some nightmares about the accident.

How the Claim Progressed

The driver got in touch with us a few months after the accident happened to discuss his options.  At that stage, although he was in pain, he felt awkward about making a claim against the other driver, even though it would be handled by her insurers and she would not actually need to be involved.  However, because he had 3 years in which to take action he was able to take some time to review his position.

In January 2007 he contacted us again as his injuries had not settled and instructed us to proceed.  We therefore wrote directly to the other driver’s insurers and within a couple of weeks they admitted responsibility for the accident.

Once we had copies of all medical records, we sent the driver to see an A&E Consultant so a detailed report could be provided.  That Consultant carefully considered the driver’s medical notes and concluded that, although he had had no symptoms in his neck or finger before the accident, x-rays taken afterwards had revealed some degenerative changes and the early onset of arthritis.  The Consultant therefore attributed 12 months of neck pain and the bringing forward of arthritic symptoms in his neck by 2 years, and also 6 months of pain and difficulties with his finger, as being specifically caused by the accident.  We were then able to place a value on the claim, to include not only the injuries but the driver’s accident related financial losses, which largely consisted of the cost of replacement of his damaged mobile phone.

We sent to the insurers all the documents supporting the value of the claim and settlement negotiations started, and we were quickly able to agree acceptable terms.

The Compensation Recovered

The driver accepted total compensation of £4,450.00.
