Our client was a pedestrian walking along a high street footpath, when she tripped on an unsecured protruding Drain Cover, causing her to sustain lacerations and bruising to her right foot, right leg and both knees.  As she fell to the ground she grazed both of her hands and suffered immediate pain in her shoulder.  She suffered from symptoms for 6 weeks following the incident and we were able to recover Personal Injury compensation for her of £6,000.

A brief summary of events is set out below.

Date of Accident:  August 2013

Time between formal instruction and successful conclusion:  We were instructed in September 2013 and settled the case just 12 months later.

How the claim proceeded:  The defendant’s Solicitors admitted liability just five months after we took on the case.  Once we had instructed a medical expert to examine our client and compile a report, we were able to provide the defendant’s solicitors with a copy, detailing her injuries.  Once they received this, we were able to start negotiating our client’s compensation.

Were Court proceedings necessary?:  No, as liability was admitted relatively quickly.

Outcome:   The client secured £5,850 for her injuries and £150 for her financial losses, including her travel expenses for visits to her GP and hospital.

Comment:  In this case, the water company responsible for the Drain cover on the footpath were already aware that it was unsafe, when our client reported it to them, admitting that they had been out to it as recently as two weeks prior to her accident, but that it had not been possible to replace or repair it.  However, they have a legal duty to ensure that drain covers on public footpaths are not dangerous and they must carry out regular inspections and repairs where necessary.  In this case, the water company failed in this duty and it is why they had to pay compensation to our client.
