TRUCK DRIVER INJURED IN SHUNT RECOVERS COMPENSATION

CASE HISTORY How the Accident Happened In November 2005 a truck driver on the M6 stopped due to traffic ahead and was struck from behind by another vehicle, pushing him onto the hard shoulder. The Injuries The driver suffered injuries to his neck and shoulders, which were particularly painful for the initial 3 week period and affected his work.  He also suffered bruising across his stomach, which settled down after a couple of weeks, and he made a full recovery from all of his symptoms within 4 months of the accident. How the Claim Progressed This should have been a straightforward claim capable of being settled fairly quickly, as the driver’s injuries were thankfully not severe.  However, the vehicle that ran into the back of him was owned by an Italian company and it was therefore necessary to establish who their insurers were and whether they had UK agents who could deal with the matter on their behalf. We had to initially liaise with the Motor Insurers’ Bureau, who in turn had to liaise with their Italian counterparts to obtain details of the company’s insurance arrangements.  This took several months, but we were finally able to direct the claim to a UK based insurance office.  They then had to liaise with the Italian company, and when they finally came back to us it was to allege that their vehicle had also been struck from behind by another lorry, and it was that driver who was ultimately at fault.  We therefore had to track down his insurers and see what they had to say. Both insurers discussed the circumstances of the accident between themselves, which led to the second insurers accepting responsibility for what had happened.  By now it was almost the first anniversary of the accident! Once we had finalised the medical evidence and details of the driver’s modest accident related financial losses, we could then value the claim.  We put to the second insurers the terms upon which he was willing to settle his claim, but they were in no hurry to consider these and to push the claim along we therefore started Court proceedings.  As we had hoped, this prompted negotiations to begin and the claim then settled. The Compensation Recovered The driver accepted total compensation of £1,375.00.
