Our client was a pedestrian who had walked to his local supermarket and as he entered the grounds of the store had to walk down a metal ramp, but as he stepped onto it, he slipped due to its smooth metal surface.  The ramp had previously been installed to prevent trolleys being taken off of the premises, but had become redundant when the trolleys had been redesigned.  Our client sustained 3 separate laceration injuries to his right shin, when it caught on a raised bolt in the ramp as he fell, Suffered Painful Symptoms for 8 weeks and scarring from all 3 wounds.  We were able to recover personal injury compensation for him of £4,300.

A brief summary of events is set out below.

Date of Accident:  December 2016

Time between formal instruction and successful conclusion:  We took on the case in January 2017 and settled it in May 2017.

How the claim proceeded:  Our client contacted us quite soon after his accident, and having taken full details, we sent a claim notification form to the supermarket responsible for his accident, via a secure electronic online portal.  We received an acknowledgement of the claim almost immediately from their solicitors and whilst waiting for a liability decision from them, we took steps to obtain copies of our client’s GP and hospital records.  Once in receipt of the medical records, we made arrangements for our client to see a Consultant Accident & Emergency Surgeon.

In February 2017 we received notification from the solicitors that the supermarket accepted responsibility for our client’s accident.  At this time, we also received a written report from the medical expert who had examined our client and provided us with a synopsis of his injuries, the symptoms he was suffering and an opinion and prognosis for his full recovery.  He documented that our client had suffered 3 laceration wounds to his shin, the one in the middle being the most serious which needed stitching.  He noted that our client had suffered painful symptoms for 8 weeks, was left with shin pain if the most serious wound scar was touched or knocked and had 3 scars in total, the appearance of which he felt would improve over an expected 18 month period.

In April 2017 we were able to value our client’s claim for compensation based on the medical evidence received and, with his authority, put forward a settlement proposal to the solicitors representing the supermarket.  Just 3 weeks later we were able to settle the case for £4,300 which our client was very pleased with.

Were Court proceedings necessary?:  No.

Outcome:  The client secured £4,300 and received his compensation just 4 months after we took on his case.

Comment:  The ramp outside the store that caused our client’s accident did not serve any purpose and was slippery due to the grooves on it running in the same direction as the flow of foot traffic.  As occupiers of the site, the supermarket had a responsibility to ensure their customers could enter the store safely, but in this instance they breached that duty of care and it is why they were responsible for paying our client compensation.
