HGV DRIVER INJURED BY FALLING LOAD RECEIVES FINANCIAL COMPENSATION

Our client was a HGV driver who was delivering a trailer loaded with beds for his employer.  On arrival at his destination he was responsible for untying the straps which held the load secure whilst in transit.  As he did so, the load fell on top of him, trapping him underneath.  He had to push the load off of himself and as he did so he felt sharp pain in his right shoulder.  He sustained injury to his right shoulder, originally thought to be a sprain, but later diagnosed as a tear to one of the tendons, which required physiotherapy to assist his recovery.  He was unable to work for one week following the accident and we were able to recover personal injury compensation for him of £1,800.

A brief summary of events is set out below.

Date of Accident:  April 2014

Time between formal instruction and successful conclusion: We took on the case in April 2016 and managed to settle it in December 2016.

How the claim proceeded: It was 2 years from the date of his accident before our client contacted us, but when he did so, he was still suffering with mild symptoms from the injury to his right shoulder.  We immediately sent for copies of his medical records and made arrangements for him to see an Orthopaedic Surgeon.  In October 2016 we received a comprehensive written report from the medical expert, in which he detailed our client’s injuries and his opinion of his prognosis for a full recovery. The expert stated that it was reasonable for our client to have taken one week off work due to his injuries and that the severe pain he suffered in his shoulder for a year afterwards was also due to his accident at work.

Once in receipt of the medical evidence, we were able to compile a schedule of our client’s financial losses and then fully value his claim for compensation.  His employer’s insurers had already admitted liability for his accident, so in early December 2016 we began settlement negotiations with them.  Just two weeks later the insurers made a sensible offer to settle the claim to our client’s satisfaction.

Were Court proceedings necessary?: No.

Outcome:   The client secured £1,800 and received his compensation just 9 months after we took on his case.

Comment: The employer failed to ensure that proper health and safety and manual handling procedures were being followed by staff loading trailers.  The employer had a responsibility to ensure that our client could carry out his work duties safely and not be at risk of injury.  In this instance, they failed in that responsibility and it is why they were liable, albeit via their insurers, for paying him compensation.
