CAR DRIVER HIT FROM BEHIND IN REAR END SHUNT SUSTAINS ONGOING INJURIES RESULTING IN SUBSTANTIAL COMPENSATION

Our client was a car driver who had just stopped behind the car travelling in front, as it was waiting to turn right.  Her vehicle was then suddenly hit from behind by another car moving at speed.  She sustained injuries to her neck, shoulders and hands, along with developing joint pain in her hips, knees, feet and elbows.  We were able to recover Personal Injury compensation for her of £10,000.

A brief summary of events is set out below.

Date of Accident:  May 2014

Time between formal instruction and successful conclusion: We took on the case in June 2015 and settled it in October 2016.

How the claim proceeded: Our client did not give us her full instructions to pursue a claim for just over a year following her accident, due to the developing and ongoing symptoms she was suffering with.  In order to get a full picture of her condition, we arranged for her to see a medical expert, who could examine her and provide us with a written report detailing his findings.  His report suggested that our client could have developed a condition called fibromyalgia as a result of her accident, but felt that only a qualified Rheumatologist could give an informed diagnosis.  He also recommended that she undergo 6-8 sessions of physiotherapy, to include ultrasound and acupuncture to assist her condition.

It was now November 2015, so we made arrangements for our client to see a specialist Rheumatologist and in early January 2016 we received his report.  The expert concluded that the symptoms experienced in her elbows, hips, knees and feet which appeared to be causing fibromyalgia were not as a result of the accident, but that the ongoing symptoms as a result of injuries to her neck and shoulders were.  His prognosis was that these symptoms should have resolved within 18 months of the accident.

By May 2016, we were able to fully value our client’s claim for compensation and begin to compile a schedule of her financial losses following the accident.  Whilst we were doing so, we received a settlement offer from the other car driver’s insurers for £5,000.  This offer was far below our valuation, so we advised our client to reject it, which she did so.

In August 2016 we were in a position to put forward a settlement proposal to the insurer’s and following several weeks of negotiation, we agreed a settlement figure with them that our client was happy to accept.

Were Court proceedings necessary?: No.

Outcome:   The client secured £9,800 for her injuries and £200 for her financial losses, including costs she had incurred having to employ a gardener and window cleaner to carry out routine jobs she had been unable to do at home due to her injuries.

Comment: Rear end shunts are one of the most common forms of road accidents and nearly always as a result of a driver going too fast or not paying attention whilst on the road.  Fortunately, our client was not severely injured, but did suffer with symptoms for nearly 18 months following the accident, which is why she received substantial compensation.
