MOTORIST WINS COMPENSATION AFTER SUSTAINING INJURIES IN COLLISION WITH DRINK DRIVER

Our client was a car driver making his way along a B-road, when a vehicle travelling in the opposite direction came around a corner on the wrong side of the road.  Our client attempted to swerve out of his path, but the vehicle collided with his car on the driver’s side.  He sustained whiplash and soft tissue Injuries to his neck, right shoulder and lower back, along with headaches and bleeding and loss of hearing in his right ear.  He suffered symptoms from his injuries for up to 7 months following the accident and required physiotherapy to aid his recovery.  We were able to recover personal injury compensation for him of £3,750.

A brief summary of events is set out below.

Date of Accident:  May 2016

Time between formal instruction and successful conclusion: We took on the case in June 2016 and settled it just four months later.

How the claim proceeded: When our client first contacted us, he was still suffering painful symptoms from the injuries sustained in the accident.  We therefore arranged for him to see a medical expert straight away, in order that he could examine him.  At this time, we also contacted the other driver’s insurers with details of his claim.  Whilst awaiting the medical expert’s written report detailing our client’s injuries and his prognosis for recovery, our client was contacted by the Police Constable who attended the accident scene, advising him that the other driver had been charged with drink driving.  Following his appearance in court when he pleaded not guilty, the case was adjourned until November 2016.

By the middle of August 2016, we had received a medical report from the expert.  His opinion was that our client should make a full recovery from his injuries within 7 months of the accident, but that 6 sessions of physiotherapy would assist the process.

We contacted the insurers with our medical findings and pressed them for a decision on liability for the accident.  Whilst one was not forthcoming, they were willing to fund and arrange the rehabilitation treatment our client required immediately.  By now it was early September 2016 and having compiled a schedule of our client’s financial losses, we were in a position to value his claim.  We began settlement negotiations with the insurers and whilst still unwilling to accept liability for the accident, it was only a relatively short period of time before they agreed to offer a sensible compensation sum to settle the claim.  They offered the sum of £3,750, plus the cost of the physiotherapy treatment, which our client was happy to accept.

Were Court proceedings necessary?: No.

Outcome:   The client secured £3,100 for his injuries and £650 for his financial losses, including his loss of earnings for the period following the accident when he was unable to work.

Comment: This case highlights the reasons why it is not safe to drink and drive over the legal limit.  Clearly the other driver’s actions on the road were impaired and left him wholly responsible for this accident.  Thankfully in this instance our client was not seriously injured, but the outcome could have potentially been so much worse.
