CASE HISTORY

How the Accident Happened

In May 2006, a HGV driver was travelling along a dual carriageway when a vehicle in front had to swerve in order to avoid colliding with a car, resulting in the HGV driver having to make an emergency stop.  Although her brake lights were on for some time after she stopped and clearly visible, a lorry travelling behind failed to slow down and stop in good time and as a result collided at speed with the rear of her vehicle.

The Injuries

The driver sustained a whiplash injury to her lower back and suffered pain down her right leg, which persisted for some time following the accident.

How the Claim Progressed

The driver contacted us shortly after her accident and once instructed we sent a formal letter of claim to the other driver’s employer and also direct to their insurers.

Whilst waiting for a response, we arranged to obtain copies of the driver’s medical records and began to compile a schedule of her financial losses, including her loss of earnings for the 6 week period following the accident when she was unable to work.

In November 2006 we were finally contacted by solicitors representing the insurers with an offer to fund rehabilitation treatment to improve the driver’s ongoing symptoms.  However, they would not admit responsibility for the accident or deal with her claim further, until they had received medical evidence to substantiate her injuries.  We had already made arrangements for her to be examined by an A&E Consultant and by the end of December 2006 we were in receipt of the medical expert’s written report.  Having considered her medical records and examined her fully, his opinion was that she should make a full recovery within 12 months of the date of the accident.

By the early part of 2007 we were in a position to fully value her claim for compensation and submitted the medical evidence and initial settlement proposal to the insurers’ solicitors.  Whilst still reluctant to provide us with a liability decision for the accident, they were willing to begin settlement negotiations.  Within just a few weeks the solicitors had put forward a reasonable offer of compensation which the driver was happy to accept.

The Compensation Recovered

The driver accepted total compensation of £4,705.43.
