LABOURER INJURED IN BUILDING SITE TRIPPING ACCIDENT RECEIVES FINANCIAL COMPENSATION

Our client was a labourer working on a new housing estate, who had been asked to clean and tidy up one of the newly built properties, which involved sweeping all of the floors.  Our client was brushing the floors in one of the rooms, when he tripped over a ladder that had been left lying in the room and struck his head against the wall.  He sustained a blow to the head, possible permanent blurred vision in his right eye, muscle damage around the eye, a sore neck, ongoing headaches, along with a laceration and swelling to his right cheek.  He suffered with acute symptoms from his injuries for 8 weeks following the Accident and we were able to recover personal injury compensation for him of £3,000.

A brief summary of events is set out below.

Date of Accident:  March 2015

Time between formal instruction and successful conclusion:  We took on the case in March 2015 and settled it in September 2016.

Whilst we were awaiting a liability decision from the solicitors, we arranged to obtain copies of our client’s medical records.  This took some time as our client had needed to attend 3 separate hospitals and his GP following the accident.  Once in receipt of the records, we forwarded them on to a medical expert for perusal, arranging for him to also fully examine our client and prepare a medical report detailing the full extent of his injuries, his expected prognosis for recovery and any ongoing symptoms.

By October 2015 our client had been seen by the medical expert and we were in receipt of his detailed report.  He described all of the injuries our client had sustained, along with the ongoing symptoms he was suffering from.  He also explained in the report that it was reasonable to expect our client to have been unable to work for 2 months following the accident, due to the nature of his injuries.

By April 2016 we had been able to calculate our client’s lost earnings for the period he could not work and fully value his claim.  Once we had done so, we submitted the medical evidence, a schedule of his financial losses and our settlement proposal to the employer’s solicitors.

Following several months of negotiation, it was the beginning of September 2016 before we could agree a settlement sum with the solicitors which our client was happy to accept.

Were Court proceedings necessary?: No.

Outcome:   The client secured £2,000 for his injuries and £1,000 for his financial losses, including his loss of earnings for the period following his accident when he could not work.

Comment:  If the employer had been following better health & safety regimes on its site, ensuring that the ladder had not been left in an unsafe place and our client had received comprehensive training before starting work there, this accident would never have happened and he would not have been injured.
