CAR PASSENGER RECOVERING FROM INJURIES CAUSED BY PREVIOUS ROAD ACCIDENT SUSTAINS AGGRAVATION OF SYMPTOMS IN REAR END SHUNT

Our client was a passenger in a stationary car, when it was hit from behind by another vehicle.  She had been unfortunate enough to be involved in a more serious road traffic Accident several months earlier, which resulted in a punctured lung and a fractured vertebrae in her neck, requiring surgery to fuse two of the vertebrae together.  She was still recovering from these injuries and had only just returned to work on reduced hours, when this more recent accident occurred.  As a result, she sustained an aggravation to her previous symptoms to such an extent that she was unable to work at all for a further period of 8 weeks.  We were able to recover personal injury compensation for her of £2,600.

A brief summary of events is set out below.

Date of Accident:  November 2015

Time between formal instruction and successful conclusion:  We took on the case in February 2016 and settled it in September 2016.

How the claim proceeded: We had already been instructed by our client to handle a compensation claim for the injuries she sustained in her first Road Traffic Accident, when she contacted us again.  Once we had been instructed a second time, we contacted the other driver’s insurers with a formal letter of claim, detailing the circumstances of the accident and her exacerbated injuries.  In just over a week the insurers had responded with an admission of liability for the accident.  We then contacted the medical expert our client had seen for examination of her previous injuries, to obtain his opinion regarding the likely period of aggravation of her symptoms caused by the second accident.  His prognosis was that her symptoms had been worsened by a period of approximately 8 weeks.  We could then value our client’s second claim and put forward a settlement proposal to the insurers.  Just two weeks later we were able to agree a settlement which our client was happy with.

Were Court proceedings necessary?:  No.

Outcome:   The client secured £1,500 for her injuries and £1,100 for her financial losses, including her loss of earnings following the accident when she was unable to work.

Comment: Unfortunately, rear end shunts occur on our roads with astonishing regularity and in most cases do not cause serious injury.  However due to the nature of our client’s existing symptoms, this accident caused a delay in her recovery by some weeks and could have seriously damaged the fused vertebrae in her neck which was still healing.
