HGV DRIVER WHO SUFFERS BLOW TO HEAD ALIGHTING FROM CAB RECEIVES FINANCIAL COMPENSATION

Our client was a HGV driver who was delivering to a business on an industrial estate.  When he arrived at the location, he stepped down to the ground from his cab, but as he did so, the slab of concrete he stepped onto gave way and moved, causing him to fall backwards, banging his head on the ground.  The blow to his head caused him to sustain a loss of consciousness, headaches and a twisted ankle, causing soft tissue damage.  We were able to recover Personal Injury compensation for him of £3,400.

A brief summary of events is set out below.

Date of Accident:  April 2016

Time between formal instruction and successful conclusion: We were instructed by our client in April 2016 and settled his case five months later.

How the claim proceeded: Having submitted a formal letter of claim to the business where our client’s accident took place, it was a relatively short space of time before we received an acknowledgement of the claim from their insurers.  Whilst waiting for them to respond further with a liability decision, we took steps to organise a medical appointment for our client with a medical expert and obtain copies of his GP and hospital records.  We also began to compile a list of his financial losses following the accident, which mainly comprised of his loss of earnings.  By the beginning of June 2016 the insurers had admitted liability for the accident and just a few weeks later our client had been examined by the medical expert and we were in possession of the written report detailing his findings.  We had also put together a schedule of financial losses, enabling us to fully value the claim.  Once we had done so, we put forward a settlement proposal to the insurers and within two weeks had been able to negotiate a sum which our client was happy to accept.

Were Court proceedings necessary?: No.

Outcome:   The client secured £3,000 for his injuries and £400 for his financial losses, including his loss of earnings for the days following his accident when he was unable to work.

Comment: Like many accidents, it could have been avoided if there had been a better health and safety regime on the premises and the concrete slab our client stepped onto had been repaired or secured appropriately.  Business owners or occupiers have a duty to ensure that you are safe when walking around their premises whether you are an employee or a visitor.
