Our client was a Hgv Driver who was instructed by his employer to collect a trailer, which had the load paperwork located inside it, from a distribution centre.  On arrival, he went to open the rear doors of the trailer, not knowing that the contents within had been badly loaded and were leaning against the inside of the doors.  As he released the catch on the first door, it sprang open with force and struck him in the face.  He sustained a blow to the head, causing a brief loss of consciousness followed by blurred vision, a deep cut above his eye which resulted in swelling and required stitching and nose bleeds.  We were able to recover Personal Injury compensation for him of £3,500.

A brief summary of events is set out below.

Date of Accident:  April 2016

Time between formal instruction and successful conclusion: We were instructed by our client in June 2016 and successfully settled his claim just one month later.

How the claim proceeded: Having received our client’s full instructions, we contacted the employer’s insurers with details of his claim.  Whilst waiting for their response, we sent for copies of his medical records, in order to arrange an appointment for him with a medical expert.  Whilst waiting for the records to arrive, we were contacted by the insurer’s admitting liability for the accident and making a substantial compensation settlement offer.  Having discussed the offer with our client, he felt he would like to accept it, as he was suffering no further symptoms from the accident and with the exception of a small scar above his eye, felt he had fully recovered.

Were Court proceedings necessary?:  No.

Outcome:   The client secured £3,000 for his injuries and £500 for his financial losses, including his loss of earnings following the accident when he was unable to work and travel expenses for various hospital visits.

Comment: In this case the employer failed to ensure that the loading of the trailer was properly supervised, as the doors had been forced shut against the load, making it unsafe and an accident waiting to happen.  If the company had followed a better system of safe practice for the loading/unloading of vehicles our client would not have sustained such injuries.
